1. Overview of Services and Definitions

  1. Platform Nature: BeautyLoops is an integrated online service and content-sharing platform connecting beauty consumers, independent makeup artists, salons, and beauty brands. We aim to provide users with beauty insights, appointment management, product recommendations, and interactive community features.
  2. User Classifications:
    • General Users (Consumers): Individuals who register and use the Platform to browse content, book services, or purchase products.
    • Professional Service Providers (Makeup Artists/Salons): Independent practitioners or entities registered on the Platform to offer professional beauty, hair, skincare, or related offline/online services.
    • Brands/Merchants: Commercial entities that showcase, promote, or sell beauty-related products on the Platform.
  3. Third-Party Services: The Services may contain links to third-party operated websites, payment gateways, or social media platforms. We assume no legal liability or responsibility for the availability, content, privacy policies, or business practices of such third parties.

2. Account Registration, Security, and Management

  1. Eligibility: You must be at least 18 years old (or have reached the age of majority in your applicable jurisdiction) with full legal capacity to register an account on this Platform. If you are registering on behalf of a company or organization, you represent and warrant that you have the authority to bind that entity to these Terms.
  2. Account Security: You are responsible for safeguarding your account password and all activities that occur under your account. You must immediately notify BeautyLoops of any unauthorized use, password breach, or other security vulnerabilities. The Platform shall not be liable for any loss or damage arising from your failure to protect your account.
  3. Information Accuracy: You agree to provide true, accurate, complete, and up-to-date personal or institutional information during registration and usage. You shall update your information promptly if it changes. BeautyLoops reserves the right to suspend or terminate your account if false or misleading information is provided.

3. User Conduct and Content Guidelines

  1. Prohibited Conduct: When using BeautyLoops, you are strictly prohibited from engaging in the following activities:
    • Violating any applicable local, national, or international laws and regulations.
    • Posting, uploading, or transmitting any false, misleading, defamatory, obscene, violent, harassing, invasive of privacy, or intellectual property-infringing content.
    • Using the Platform for unauthorized commercial advertising, spam distribution, or multi-level marketing schemes.
    • Attempting to bypass, disrupt, or hack the Platform’s security systems, encryption technologies, or access control mechanisms.
    • Using any automated scripts, web scrapers, robots, or data collection tools to harvest data from the Platform.
  2. User-Generated Content (UGC): You bear sole legal responsibility for any reviews, photos, videos, articles, or other content you post on the Platform.
    • You grant BeautyLoops a global, royalty-free, non-exclusive, sublicensable license to use, reproduce, modify, display, and distribute the content you post on the Platform and related marketing channels.
    • We reserve the right to remove, block, or refuse to publish any user content that violates these Terms or is suspected of being illegal, without prior notice.

4. Bookings, Transactions, and Refund Policies

  1. Service Bookings:
    • Users may submit service booking requests to makeup artists or salons through the Platform. Once a booking is confirmed by the service provider, a binding service contract is formed between the user and the service provider.
    • The Platform acts solely as a technical service provider facilitating transactions and does not directly provide offline beauty services. Quality, safety, and disputes arising from offline services shall primarily be resolved through negotiations between the user and the actual service provider, though the Platform may offer necessary customer service coordination support.
  2. Fees and Payments:
    • Users shall pay the corresponding service fees or product prices in accordance with the prices and payment methods displayed on the Platform. All listed prices include or explicitly specify whether they include applicable taxes.
    • Payment processing may be handled by industry-standard third-party payment gateways. You agree to comply with the terms of service of such third-party payment providers.
  3. Cancellation and Refund Policies:
    • Consumer Cancellations: To cancel a booked service, users must perform the operation through the Platform within the specified time window prior to the service start time. Late cancellations may incur liquidation damages or result in the forfeiture of deposits, subject to the specific rules set by the individual makeup artist or salon.
    • Service Provider Cancellations: If a booking is cancelled due to reasons attributable to the service provider, the Platform will assist the user in securing a full refund and provide compensation options based on the circumstances.

5. Intellectual Property Rights

  1. Platform Ownership: All software, interface designs, texts, graphics, logos, icons, audio, videos, and data compilations on the BeautyLoops Platform are owned by BeautyLoops or its licensors and are protected by copyright, trademark, and other intellectual property laws.
  2. Usage Restrictions: Without the prior explicit written permission of BeautyLoops or the relevant rights holders, no one may modify, copy, distribute, rent, sell, reverse engineer, or otherwise exploit any core assets or proprietary technology of the Platform.

6. Disclaimers and Limitation of Liability

  1. “As Is” Basis: The Services are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. BeautyLoops does not guarantee that the Services will be uninterrupted, timely, secure, or error-free.
  2. Medical and Allergy Disclaimers:
    • Beauty and skincare advice on the Platform is for informational purposes only and cannot substitute for professional medical diagnosis, advice, or treatment.
    • Users are responsible for performing a patch test before using any beauty products or receiving beauty services. BeautyLoops shall not be held legally liable for any adverse reactions resulting from a user’s personal allergic constitution or failure to follow product instructions.
  3. Limitation of Liability: To the maximum extent permitted by law, BeautyLoops and its parent companies, affiliates, directors, employees, or agents shall not be liable for any indirect, incidental, special, punitive, or consequential damages (including but not limited to loss of profits, loss of data, or damage to goodwill), whether based on contract, tort, negligence, strict liability, or otherwise.

7. Modifications and Termination of Terms

  1. Modification of Terms: We reserve the right to modify these Terms at any time based on business developments, regulatory changes, or technological upgrades. Modified terms will be published on the Platform and will take effect immediately. Your continued use of the Services after the modifications take effect constitutes your acceptance of and agreement to be bound by the revised Terms.
  2. Termination of Services:
    • You may terminate your relationship with BeautyLoops at any time by closing your account.
    • If we have reasonable grounds to believe that you have violated these Terms, laws and regulations, or harmed the legal rights of the Platform, we reserve the right to suspend, restrict, or terminate your account and access to the Services without prior notice.

8. Governing Law and Dispute Resolution

  1. Governing Law: The conclusion, execution, interpretation, and dispute resolution of these Terms shall be governed by the laws of the jurisdiction where the Platform’s operating entity is located (excluding conflict of law rules).
  2. Dispute Resolution: Any dispute arising from or in connection with these Terms shall first be resolved through friendly negotiations between the parties; if negotiations fail, either party may submit the dispute to the competent people’s court located where the BeautyLoops operating entity is registered.
